Songjog Connecting People Foundation is a registered nonprofit, non-political, and non-discriminatory organization working in areas that include education and digital learning, skill development and employment, healthcare, climate and disaster response, youth and women empowerment, and human rights and advocacy.

The Website provides information about the Foundation and its:

Publication of information about a Project, event, grant, service, application, or opportunity does not guarantee availability, eligibility, selection, funding, participation, employment, support, or any particular result.

By using the Website, you represent that:

  • You will use the Website only for lawful purposes;
  • Information you submit will be accurate and not intentionally misleading;
  • You will not impersonate another person or organization;

7. Intellectual Property Ownership

All Content made available through the Website, including but not limited to the following, is owned by Songjog Connecting People Foundation or used by the Foundation with appropriate permission or license:

  • The name “Songjog Connecting People Foundation”;
  • The Songjog name and organizational identity;
  • Logos, emblems, campaign identities, slogans, and visual branding;
  • Website text, articles, notices, reports, policies, and publications;
  • Project descriptions, activity summaries, research, methodologies, and documentation;
  • Photographs, videos, audio recordings, illustrations, and graphics;
  • Beneficiary stories, case studies, testimonials, quotations, and impact narratives;
  • Training materials, educational resources, presentations, and downloadable files;
  • Website design, page structure, layouts, icons, and interface elements;
  • Databases, compilations, archives, and organized collections;
  • Original translations, captions, summaries, and adaptations;
  • Fundraising messages, donation appeals, campaign materials, and promotional content.

All applicable intellectual property rights are reserved. No transfer of copyright, trademark, database right, design right, licensing right, publicity right, or other intellectual property right occurs merely because Content is publicly accessible through the Website.

8. No Copying or Reuse Without Written Permission

Except where applicable law expressly provides otherwise, no person or organization may copy, reproduce, download for republication, republish, distribute, display, communicate, transmit, translate, adapt, modify, archive, mirror, scrape, extract, sell, license, commercialize, or create derivative material from Website Content without the prior written permission of Songjog Connecting People Foundation.   • Upload Songjog materials to a content repository, dataset, or automated system;
  • Systematically extract Content using software, bots, crawlers, or scraping tools;
  • remove, crop, conceal, or alter a watermark, logo, credit, ownership notice, or contextual information.

Providing attribution, linking to the Website, or stating that Content belongs to Songjog does not replace the requirement to obtain written permission. Silence, failure to object immediately, prior informal communication, or availability of Content online does not constitute authorization.

9. Brand, Name, and Logo Protection

The Foundation’s name, logo, brand identity, campaign names, and other identifying materials may not be used without prior written authorization. No person or organization may use a name, logo, domain, account name, page design, or visual identity that:

  • Is identical or confusingly similar to Songjog’s identity;
  • Falsely suggests an official connection with Songjog;
  • Implies endorsement, sponsorship, partnership, affiliation, representation, or authorization;
  • Could cause donors, beneficiaries, volunteers, partners, or members of the public to believe they are communicating with Songjog;
  • Diverts Website visitors, donations, applications, or personal information away from the Foundation;
  • Damages or exploits the Foundation’s reputation.

A person or organization may not describe itself as a Songjog branch, chapter, affiliate, partner, agent, representative, volunteer group, fundraising team, Project office, or authorized organization unless that status has been granted through an approved written agreement.

10. Impersonation and Misleading Websites

It is strictly prohibited to create, operate, promote, or support any misleadingly similar:

  • Website or domain name;
  • Social media profile, page, group, or account;
  • Email address or messaging account;
  • Mobile application or digital platform;
  • Donation or crowdfunding page;
  • Advertisement or sponsored post;
  • Registration or beneficiary application form;
  • Volunteer recruitment form;
  • Publication, notice, or press release;
  • Event, Project, or campaign.

No person may copy Songjog Content or design features in a way that creates the false impression that another website, platform, campaign, or communication is owned, approved, sponsored, or operated by Songjog.

11. Unauthorized Fundraising and Data Collection

Songjog Connecting People Foundation does not authorize any person or organization to collect donations, payments, sponsorships, grants, membership fees, registration fees, beneficiary information, volunteer information, donor information, identity documents, banking details, or other personal data in its name unless the Foundation has granted express written authorization. Without such authorization, no person or organization may:

  • Request donations using Songjog’s name, Content, logo, photographs, Projects, or reputation;
  • Create a donation page claiming to support a Songjog Project;
  • Publish payment details that appear to belong to Songjog;
  • Collect personal information through a copied Songjog form;
  • Invite beneficiaries, volunteers, employees, partners, or donors to submit information;
  • Claim that funds or information will be transferred to Songjog;
  • State or imply that a collection has been approved by the Foundation;
  • Use an individual bank account, mobile financial service account, wallet, or payment channel to collect funds in Songjog’s name without written authorization.

Songjog is not responsible for money, information, documents, or credentials submitted to an unauthorized person, account, page, platform, or website. Members of the public should verify payment instructions through the official Website or by contacting Songjog directly at info@songjog.org or +880 9638-119900.

12. Fraudulent Collection of Personal Information

Copying Songjog Content for the purpose of collecting user information, donor information, beneficiary data, identity documents, phone numbers, email addresses, account credentials, or financial information is strictly prohibited. Songjog may report suspected phishing, identity theft, impersonation, unauthorized data collection, or fraudulent solicitation to:

  • Law-enforcement and cybercrime authorities;
  • Government and regulatory authorities;
  • Domain registrars and registry operators;
  • Hosting and cloud-service providers;
  • Search engines;
  • Social media and messaging platforms;
  • Banks, mobile financial service providers, and payment processors;
  • Advertising networks;
  • Email-service providers;
  • Other relevant service providers or competent authorities.

Where appropriate and lawful, Songjog may notify affected individuals or publish a fraud warning.

13. Permission Requests

Requests to use Songjog Content must be submitted to info@songjog.org before the proposed use begins. A request should clearly identify:

  • The person or organization requesting permission;
  • The specific Content requested;
  • The intended purpose;
  • The proposed publication channel;
  • Whether the use is commercial, fundraising, educational, or promotional;
  • The intended audience and territory;
  • The proposed duration of use;
  • Whether the Content will be edited, translated, or adapted.

Permission is valid only when provided in writing by a person authorized to act for Songjog Connecting People Foundation. Songjog may grant, limit, condition, or refuse permission at its discretion, subject to applicable law. Authorization for one use does not authorize any other use. The Foundation may require attribution, contextual safeguards, safeguarding protections, removal after a specified period, or other reasonable conditions.

14. Third-Party Materials

Some Website Content may belong to partners, photographers, contributors, licensors, or other third parties. Songjog’s permission cannot be assumed to cover third-party rights. A person seeking to use such Content may need separate authorization from the relevant rights holder. A link, credit, source note, or partner acknowledgement does not mean that third-party Content is freely available for reuse.

15. Reporting Suspected Infringement or Fraud

A person should not put themselves at risk, engage directly with a suspected fraudster, or disclose additional sensitive information merely to collect evidence.

16. Monitoring, Investigation, and Enforcement

Songjog Connecting People Foundation reserves the right to monitor publicly accessible sources for unauthorized use of its Content, identity, branding, Projects, and fundraising materials. Where misuse is suspected, the Foundation may, to the extent permitted by law:

  • Preserve screenshots, source code, page captures, messages, transaction details, and other evidence;
  • Investigate the apparent owner, operator, registrant, host, payment recipient, or advertiser;
  • Send a warning, demand, or cease-and-desist notice;
  • Submit a copyright, trademark, impersonation, phishing, fraud, privacy, or platform complaint;
  • Request removal, disabling, de-indexing, suspension, or preservation of relevant material;
  • Request suspension of a website, domain, account, advertisement, payment facility, or fundraising campaign;
  • Notify donors, beneficiaries, partners, or members of the public;
  • Refer the matter to law-enforcement, cybercrime, financial, regulatory, or other competent authorities;
  • Seek an injunction or other court order;
  • Pursue damages, an account of profits, delivery-up, destruction, costs, or other remedies available under applicable law.

Songjog may take appropriate action without first notifying the suspected infringer where advance notice could result in destruction of evidence, movement of funds, further victimization, concealment of identity, or continued harm. Nothing in these Terms guarantees that a court, platform, registrar, hosting provider, payment provider, or authority will grant a particular remedy.

17. Preservation of Rights

Failure or delay by Songjog in identifying, reporting, or taking action against unauthorized use does not constitute:

  • Permission;
  • Consent;
  • A license;
  • Approval;
  • Abandonment of rights;
  • Waiver of any available remedy.

Any waiver must be express and provided in writing by an authorized representative of the Foundation.

18. User Submissions

If you submit information, photographs, videos, documents, feedback, applications, stories, or other materials through the Website, you confirm that:

  • You have the right and authority to submit them;
  • The materials are accurate to the best of your knowledge;
  • The submission does not violate another person’s rights;
  • The material does not contain unlawful or malicious content;
  • You have obtained any necessary consent before disclosing another person’s information.

You remain responsible for the materials you submit. Submission of material does not automatically transfer ownership to Songjog. You grant the Foundation a limited right to receive, store, review, and use the material for the purpose for which it was submitted and for related lawful administrative purposes. Public use of identifiable photographs, stories, testimonials, or personal information will remain subject to appropriate permission, privacy, safeguarding, and ethical requirements.

19. Donations

Donations made through an authorized Songjog channel are voluntary contributions intended to support the Foundation’s charitable purposes. A donation does not create:

  • Ownership or membership rights;
  • Voting or governance rights;
  • Employment, agency, or partnership;
  • Control over the Foundation’s operations;
  • A legal right to participate in a Project;
  • A guarantee of recognition, publicity, or access;
  • A financial return.

Unless Songjog expressly accepts a restriction in writing, donations may be used for lawful charitable activities and reasonable Project, administration, safeguarding, monitoring, technology, compliance, fundraising, banking, and operational costs. If a specified activity becomes completed, fully funded, delayed, impracticable, unsafe, unlawful, or impossible to implement, Songjog may, where legally permitted and consistent with its donor communications, use the funds for a substantially similar charitable purpose or another area of organizational need. Donation refunds are governed by the Foundation’s Donation and Refund Policy.

20. Right to Refuse or Return Support

Songjog may refuse, suspend, investigate, or return a donation, sponsorship, grant, in-kind contribution, or proposed partnership where acceptance may reasonably:

  • Violate applicable law or regulatory requirements;
  • Involve fraud, unlawful proceeds, money laundering, terrorist financing, or sanctions concerns;
  • Create unacceptable safeguarding, ethical, reputational, operational, or financial risk;
  • Compromise the Foundation’s mission, independence, or governance;
  • Include conditions that Songjog has not accepted;
  • Result from an apparent payment or technical error.

21. Applications, Participation, and Opportunities

Submitting an application, registration, expression of interest, volunteer form, employment application, beneficiary inquiry, or partnership proposal does not guarantee:

  • Acceptance or selection;
  • Employment or volunteer placement;
  • Participation in a Project or event;
  • Financial or material support;
  • A partnership or funding agreement;
  • Reimbursement of expenses;
  • A response within a particular period.

Songjog may assess submissions according to applicable eligibility, safeguarding, due-diligence, operational, funding, and Project requirements.

22. External Websites and Services

The Website may contain links to third-party platforms, payment providers, embedded content, or external websites. Songjog does not control and is not responsible for the availability, accuracy, content, security, privacy practices, transactions, or services of independent third parties. A link does not necessarily indicate endorsement, sponsorship, partnership, or approval. Users should review the applicable third party’s terms and privacy practices before providing information or completing a transaction.

23. No Professional Advice

Website Content does not constitute legal, medical, psychological, financial, investment, tax, employment, safeguarding, or other professional advice. Users should obtain advice from an appropriately qualified professional before making decisions that require individualized professional judgment.

Songjog makes reasonable efforts to maintain accurate and current Website information. However, the Foundation does not guarantee that:

To the fullest extent permitted by applicable law, the Website and its Content are provided on an “as available” basis. Songjog does not provide any warranty that is not expressly stated in writing. Nothing in these Terms excludes a warranty, duty, or right that cannot lawfully be excluded.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Songjog Connecting People Foundation will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising solely from:

  • Use of or inability to use the Website;
  • Reliance on Website Content;
  • Technical interruption or loss of availability;
  • Third-party websites, payment providers, or services;
  • Unauthorized websites, accounts, or persons impersonating Songjog;
  • Information or funds voluntarily provided to an unauthorized third party.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot lawfully be excluded for fraud, wilful misconduct, or other non-excludable matters.

27. User Responsibility

You are responsible for losses, claims, liabilities, or reasonable costs arising from your unlawful use of the Website, intentional misconduct, unauthorized fundraising, infringement of intellectual property, impersonation of Songjog, fraudulent collection of information, or material breach of these Terms. Any responsibility to compensate Songjog will apply only to the extent permitted by applicable law.

28. Safeguarding

29. Force Majeure

  • Cyber incidents;

30. Suspension and Restriction

Songjog may restrict access, reject submissions, block technical activity, preserve relevant evidence, or report suspected unlawful conduct where reasonably necessary to protect:

  • Volunteers and personnel;

31. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the People’s Republic of Bangladesh. Any dispute arising from or relating to these Terms or use of the Website should first be submitted to Songjog in writing for good-faith resolution. If the dispute cannot be resolved, it will be subject to the jurisdiction of the competent courts of Bangladesh, except where applicable law requires another procedure or jurisdiction.

32. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable by a competent authority, that provision will be limited or interpreted only to the minimum extent necessary. The remaining provisions will continue to apply where legally possible.

33. No Waiver

Failure to enforce any provision immediately does not waive Songjog’s right to enforce that provision later. A waiver is valid only if it is made expressly and in writing by an authorized representative of Songjog Connecting People Foundation.

34. Changes to These Terms

Songjog may revise these Terms to reflect legal, operational, technological, security, or organizational changes. The current version and its effective date will be published on this page. Continued use of the Website after a revision means that the revised Terms apply to subsequent use, subject to applicable law.
